Will the profession of Rechtspfleger be introduced into Croatia?

Heidi Hell, General Secretary E.U.R. + Dražen Bošnjaković, Minister of Justice CroatiaThe Minister of Justice of Croatia, Mr. Dražen Bošnjaković, had invited the board of the European Union of Rechtspfleger to a conversation about the project of the E.U.R. concerning the introduction of an European Rechtspfleger.

Mrs. Heidi Hell, the General Secretary of the E.U.R., noticed this appointment in the Ministry of Justice on March the 7th in 2011.
Also Mrs. Barica Novosel, an adviser of the minister, took part in this discussion, also the Cabinet Secretary, Mr. Miljenko Petrak, the director of the directors board of the organisation of judges, Mr. Zlatko Hamarić, and Mrs. Nikolina Milić, technical consultant, were present.

In view of the desired early accession to the European Union, there are moves to change the Croatian judicial system. The introduction of the occupation of the Rechtspfleger could play an important role in this story.

The judges in Croatia are supported by so-called consultants. The consultants write for the judges the judgments. They have despite a high level of education no authority to sign the decisions themselves. Mrs. Hell stressed that it should be possible to make this system more efficient. The consultants could get more tasks in areas of voluntary jurisdiction, as in the land register, in the commercial register of enforcement, in legal guardianship, in which they can decide a factual independence. The judges should focus on civil and criminal proceedings, and write their judgements themselves.

The General Secretary of the E.U.R. handed over the Green Paper for a European Rechtspfleger to the Croatian Minister of Justice and thanked him for the interest in the profession of the European Rechtspfleger. Mr. Dražen Bošnjaković assured that he will include the thoughts that this paper reflects in the review of changes in the judiciary in Croatia.
