50 Years Federal Patent Court

European Rechtspfleger at the European Patent Court

Federal President Christian WulffAt 1 July 2011 the Federal Patent Court was celebrating its 50 years anniversary. The president of the European Union of Rechtspfleger (E.U.R.) attend the celebration. He is already working at this court 30 years. The court is competent for all procedures of the industrial property law.

The court decides in patent, trade marks, utility models, topographies and design cases. Because of its tasks the court is unique. At the court there are legally qualified and technically qualified members as judges, for instance like graduate engineers, physicists and chemists. Also Rechtspfleger decide in the context of the admissibility of claims and appeals about the progress of the procedures.

In his welcome address, the Federal President Christian Wulff spoke of the possible creation of a European Patent Court, which could possibly have its headquarters in Munich. Munich is the center of intellectual property protection. Also, the Federal Minister of Justice, Sabine Leutheusser-Schnarrenberger sees the possibility that the European Patent Court could arise from the Federal Patent Court. Until then, it will take some years. The European Rechtspfleger, however, could be found in this European court.
