The President of the Spanish National Federation of the European Union of Rechtspfleger Rafael Lara Hernández has invited the President of the European Union of Rechtspfleger (EUR) Thomas Kappl to the 25th Congress of the Ilustre Colegio Nacional de Secretarios Judiciales in Cadiz.
The Spanish federation has selected the city of Cadiz for the Congress, because in this city was signed the first constitution for Spain in 1812. In the history of the city geographic location played an important role. In 1100 BC the city was founded by the Phoenicians. She was the center of trade from both, the Mediterranean Sea and the Atlantic Ocean.
Later the Carthaginians and afterwards the Romans settled down there. Alfonso X, King of Castile and León conquered Cadiz in 1262 and drove out the Moors. During the Spanish War of Independence (1808-1814) Cadiz remained vacant. During this time, the first constitution for Spain was worked on and brought into force on 19 March 1812, La Pepa (as Joseph of Nazareth, the saint of that day).
A special attraction is the old bath house at the beach. Halle Maria Berry got there off the water in the James Bond film "Die Another Day" and not in Havana, Cuba, as portrayed in the film.
As other guests Antonio Dorado Picón, member of the Council of Justice, Lorenzo del Rio, president of the Higher Regional Court of Andalusia, and José de la Mata Amaya, General Director for the modernization of the judiciary, were present.
As well as the European Union of Rechtspfleger the Spanish federation was concerned with the modernization of the judiciary in an economic crisis and in times of scarce public resources and the future prospects and the role of the Judicial secretary.
On this topic Kappl emphasized in his speech that the global economic and financial crisis which already lasted long, has not yet finished. The crisis gets to more and more countries in Europe and around the world. It also reaches the citizens in Europe, which are due to the general financial difficulties faced by an increasing number of court proceedings. At the court proceedings are mainly the national and European order for payment, foreclosures, bankruptcy procedures, the Commercial Register and the Land Registry. These are procedures that can be taken over on a Rechtspfleger in a united area of the European Union. A discharge of the judge could be caused.
The Romanian Minister of Justice, who attended the meeting in Bucharest, has recognized the situation in his country. The European Union of Rechtspfleger welcomes the initiative by the Romanian Ministry of Justice to submit the Romanian government a bill for the creation of the profession of Rechtspfleger and Court Manager, based on the Green Paper for a European Rechtspfleger.
We are convinced, as the President of the E.U.R. told that other states will follow this example. We invite the European countries to adapt the recognized profession of the European Rechtspfleger in their judicial systems according to the Green Paper and the recommendation of the CEPEJ.
After his speech Thomas Kappl handed out the Green Paper for a European Rechtspfleger to Mr. José de la Mata Amaya, the representative of the Spanish Minister of Justice.
