E.U.R. in the Ministry of Justice in Den Haag

Discussion about the transfer of judicial tasks

In presence of the member of the board of the Dutch Association Kring van Secretarissen in Nederland Jacques Haanen the President of the European Union of Rechtspfeger (E.U.R.) Thomas Kappl met the Director of the Department of Justice Systems, Mr. J.J. (just) Stam LMM, the Director of the Department of International Affairs Mr. Jan Terstegen, and the consultant for judical systems, Mr. Dr. P Albers as representatives of the Dutch Ministry of Justice on November the 30th in 2011 in Den Haag.

Within an intensive talk the recent role of the the judicial employees (gerechtssecretarissen) in the Dutch courts was discussed. Some tasks, foreseen in the Green Book of European Rechtspfleger are not tasks of the Dutch courts, for example the decisons in the Land- and Commercial Register, also probate proceeding.

There are possibilities in other parts to transfer judicial tasks on the judicial employees. Kappl reported on his first visit in the Netherlands in February 2009, when he was discussing about the Green Paper and the tasks of an European Rechtspfleger with the President of the Raad voor de Rechtspraak, Mr. Erik van den Emster. Van den Emster garanted to make a research or survey with the presidents of the courts about the transfer and give the results to the E.U.R. The Director of the Department of Justice Systems, Mr. Stam will ask Mr. van den Emster which result this survey contains.

Kappl handed out the Green Paper to Mr. Stam, who will concentrate on this Book for determining, if the transfer of judicial tasks to the judicial employees would promote an efficient justice which is close to the citizens. Stam will give further informations to the E.U.R..
