CEPEJ Working Group on Mediation, 24-25 May 2018, Council of Europe, Strasbourg

The CEPEJ Working Group on Mediation was set up in 2006 to promote and support the implementation of the recommendations issued by the Council of Europe’s Committee of Ministers relating to mediation. Its work has allowed the Council of Europe to publish in 2007 several Guidelines for a better implementation of existing recommendations.

The need for mediation has grown over the years and in 2017 it appeared necessary to complement these guidelines with practical tools allowing for States to implement and develop mediation. CEPEJ Working Group on Evaluation, 15-17 May 2018, Council of Europe, Strasbourg

The CEPEJ Statute emphasizes the comparison of judicial systems and the exchange of knowledge on their functioning. The scope of this comparison goes beyond efficiency stricto sensu because it is specifically interested in the quality and efficiency of justice.

Strasbourg, 5 and 6 April 2018: meeting of the SATURN Group of the European Commission for the Efficiency of Justice (CEPEJ)

The Steering Committee of the SATURN Centre for Judicial Time Management met in Strasbourg on 5 and 6 April 2018. Following the election of its President, Giacomo Oberto, judge at the Turin Court (Italy), his work mainly concerned the construction of a case weighting indicator for the courts. This system must in particular allow an equitable distribution of cases not only between the judges of the same court but also between the different staff and registry services (clerks/Rechtspfleger) as pointed out by the EUR. 16 November, Strasbourg, France : Meeting of the CEPEJ Working Group on Mediation

Judicial mediation is one of the specific competences that can be entrusted to the Rechtspfleger / Greffier for Europe (RGpE) according to the principles laid down in the White Paper published by our Union in September 2016. The RGpE has all the guarantees of training and independence to take charge of these cases and thereby relieve the judge of a significant part of his activity. In some states whose professional organizations have joined the EUR, the non-judge staff are conducting mediations (Spain, Hungary).
Successful mediation contributes to the decongestion of the courts. The subject is therefore also of interest to the European Commission for the Efficiency of Justice of the Council of Europe (CEPEJ), which last year reactivated its working group on the subject. The EUR hopes that the mandate of this group, initially for one year, will be renewed for one or two additional years. 14 November, Tirana, Albania : EUR Participation to the SEJ 2 Project

The EUR was invited by the CEPEJ to present the White Paper for a Rechtspfleger / Greffier for Europe to the 10 Albanian courts participating in the SEJ 2 project. This project, co-funded by the European Union and the Council of Europe, aims to improve the efficiency and quality of justice in Albania. It follows a first project that resulted in recommendations that were used by the Albanian authorities in the development of a new legislative framework for the functioning of justice. The seminar of 14 November followed this series of reforms and aimed at studying the respective tasks, current and future, of the different professions. Also participating in this project as experts of the CEPEJ are Mr. Marco Fabri, an Italian researcher and Mr. Jon Jonsen, Law Professor from Norway. 19-20 October 2017, Strasbourg, France : Meeting of the CEPEJ Working Group on the Quality of Justice

The Working Group on the Quality of Justice of the European Commission for the Efficiency of Justice (CEPEJ) met on 19 and 20 October 2017 at the Council of Europe in Strasbourg. Jean-Jacques KUSTER represented the E.U.R.

30 June 2017, Strasbourg, France : 29th CEPEJ Plenary Meeting

On 30 June 2017, the European Commission for the Efficiency of Justice (CEPEJ) held its plenary session at the Council of Europe headquarters in Strasbourg. The EUR was represented by Vivien Whyte.
